Here are three questions for Mr. Holder. First, why did the Justice Department choose to argue the case against the Hosanna-Tabor Evangelical Lutheran School in 2011? The department’s lawyers argued that the federal government has a right to overrule a church’s employment decisions on the hiring and firing of its ministers and religion teachers. The Justice Department argued a view of the First Amendment that the government could interfere with the internal decisions of the church and deprive the church of control over the selection of leaders who represent its beliefs. The Supreme Court, however, rejected these arguments and voted 9-0 to uphold the rights of the school to make its own employment decisions.Crooked Eric Holder really is an embarrassment to the rule of law.
