The federal judge overseeing the criminal case against five former members of the San Diego retirement system dismissed all charges against them Wednesday, saying the law under which they were charged is too vague to be used against them.
U.S. District Judge Roger Benitez’s 28-page ruling concluded that the federal honest services fraud law “failed to give these defendants fair warning that their conduct could violate the federal mail and wire fraud statutes.”
