In my post yesterday on Wal-Mart's announcement to sell 300 generic drugs at $4 a prescription, I forgot to add what is going to be an obvious line of attack on the company: "predatory" pricing. Many years ago, pharmacists in Arkansas got the courts to order Wal-Mart to increase its drug prices, as the company was "violating" the state's "predatory pricing" law.Those who want to restrict markets are the enemies of poor people.
I can guarantee you that pharmacists across the country will be in a long line to sue Wal-Mart under state statutes and under the federal Robinson-Patman Act, which was passed in 1936 in an attempt to put A&P out of business. (Like Wal-Mart today, the critics declared that A&P was a grave threat to the nation's economy.)
