Did a 1926 Supreme Court decision lead to Kelo?
The rather infamous 1926 court decision VILLAGE OF EUCLID, OHIO v. AMBLER REALTY CO.which allowed zoning was probably an important building block in handing the state unlimited powers. If you can zone it you can regulate it,if you can regulate it you can take it.Not a good moment for George Sutherland who wrote the opinion.Sutherland generally defended property rights, but not here.FindLaw
